_module_preset=\u00a0\u00bbdefault\u00a0\u00bb hover_enabled=\u00a0\u00bb0&Prime; global_colors_info=\u00a0\u00bb{}\u00a0\u00bb sticky_enabled=\u00a0\u00bb0&Prime;]<\/p>\n<h2>La Cour supr\u00eame du Canada a interdit la discrimination fond\u00e9e sur l\u2019orientation sexuelle<\/h2>\n<p>De nombreuses \u00e9tapes importantes ont \u00e9t\u00e9 c\u00e9l\u00e9br\u00e9es dans la lutte pour les droits des personnes 2ELGBTQI+ au Canada. Le 2 avril 1998, la Cour supr\u00eame du Canada a rendu une d\u00e9cision dans un dossier o\u00f9 un travailleur a \u00e9t\u00e9 cong\u00e9di\u00e9 parce qu\u2019il \u00e9tait gai.<\/p>\n<p>En 1991, Delwin Vriend, un coordonnateur d\u2019un laboratoire de chimie \u00e0 Edmonton (Alberta), travaillait au King&rsquo;s College qui \u00e9tait affili\u00e9 \u00e0 la Christian Reformed Church. Monsieur Vriend, qui parlait ouvertement de sa relation avec un partenaire de m\u00eame sexe, s\u2019est fait dire par son superviseur de d\u00e9missionner parce qu\u2019il violait la \u00ab d\u00e9claration des convictions religieuses \u00bb du coll\u00e8ge ou sinon il serait cong\u00e9di\u00e9. Lorsqu\u2019il a refus\u00e9, le coll\u00e8ge l\u2019a cong\u00e9di\u00e9.<\/p>\n<p>Monsieur Vriend a communiqu\u00e9 avec la Commission des droits de la personne de l\u2019Alberta dans l\u2019espoir de d\u00e9poser une plainte pour discrimination, mais sa demande a \u00e9t\u00e9 refus\u00e9e puisque l\u2019orientation sexuelle n\u2019\u00e9tait pas prot\u00e9g\u00e9e par le Code sur les droits de la personne de la province. Faute de pouvoir faire valoir ses droits, il a d\u00fb se tourner vers les tribunaux et il a poursuivi le Gouvernement de l\u2019Alberta et sa Commission des droits de la personne.<\/p>\n<p>En 1994, un tribunal albertain a statu\u00e9 que l\u2019orientation sexuelle doit \u00eatre trait\u00e9e comme un motif prot\u00e9g\u00e9 en vertu de la loi sur les droits de la personne. Le gouvernement conservateur de la province a interjet\u00e9 appel et, en 1996, la Cour d\u2019appel de l\u2019Alberta a renvers\u00e9 la d\u00e9cision du tribunal de premi\u00e8re instance. Monsieur Vriend a par la suite interjet\u00e9 appel devant la Cour supr\u00eame du Canada et le Congr\u00e8s du travail du Canada a \u00e9t\u00e9 un des intervenants dans son dossier.<\/p>\n<p>Finalement, en 1998, le tribunal a rendu une d\u00e9cision dans l\u2019affaire Vriend c. Alberta. Le tribunal a conclu qu\u2019il n\u2019y a pas de fondement juridique pour faire une distinction dans la Charte des droits et libert\u00e9s entre un acte positif et une omission dans la loi. Bien que la loi sur les droits de la personne de l\u2019Alberta et la Charte canadienne des droits et libert\u00e9s aient omis toute r\u00e9f\u00e9rence \u00e0 l\u2019orientation sexuelle, la d\u00e9cision stipulait, bien que cela n\u2019ait pas \u00e9t\u00e9 \u00e9crit explicitement, que l\u2019orientation sexuelle \u00e9tait un motif de discrimination interdit.<\/p>\n<p>La d\u00e9cision rendue dans l\u2019affaire Vriend c. Alberta a \u00e9t\u00e9 utilis\u00e9e avec succ\u00e8s dans des contestations judiciaires au sujet d\u2019interdictions provinciales de mariages entre partenaires de m\u00eame sexe partout au Canada.
